Summary of Terms & Conditions

(This is a summary only. The full Terms & Conditions apply and contain the complete legal detail.)

Before You Book

  • Payment secures your spot — check your invoice for deposit or full payment requirements.
  • Prices shown are in AUD, including GST unless stated otherwise.

Cancellations & Changes

  • Tell us in writing if you need to cancel. Refunds follow the cancellation policy from when you booked.
  • Noshows or late arrivals normally lose their payment.

Things Beyond Our Control (Force Majeure)

  • If bushfires, floods, road closures, pandemics, or other big events stop us from running, we’ll try to offer alternatives, but we can’t promise availability.

Safety & Behaviour

  • Follow staff instructions at all times.
  • Zero tolerance for unsafe conduct, harassment, excessive alcohol, or drug use during services.

Photos & Media

  • We may take photos/videos for marketing or safety. You can opt out by telling us in writing before your booking date.

Permits & Access

  • Some locations need special permits (e.g. national parks, Aboriginal land). If permits aren’t available, we may adjust routes without liability.

Gear & Equipment

  • You’re responsible for your own or hired gear (bikes, surfboards, cameras, motorsport kit).
  • We’re not liable for loss/damage unless due to our proven negligence.

Property Damage

  • You’ll need to cover costs for damage you cause to our vehicles or property beyond normal wear and tear.

Health Info

  • Please tell us about medical conditions, allergies, or medications that could affect safety. We handle this info confidentially.

Outcomes Not Guaranteed

  • Weather, wildlife sightings, and adventure results aren’t guaranteed — part of the experience is the unknown.

ThirdParty Services

  • If another business provides part of your trip (accommodation, dining, activities), we’re not responsible for their service or safety.

Problems & Disputes

  • We aim to resolve issues through friendly discussion first, then mediation if needed, before formal legal action.

1. Booking & Payment

  • Full payment (or agreed deposit) is required to confirm your booking.
  • Prices are in Australian dollars and inclusive of GST unless stated otherwise.
  • We reserve the right to amend pricing prior to confirmation in the event of changes in costs or taxes.

2. Cancellations & Refunds

  • Cancellations must be made in writing.
  • Refunds (if applicable) will be processed in accordance with our cancellation policy at the time of booking.
  • Nonattendance or late arrival may forfeit your payment.

3. Force Majeure

We are not liable for delays, changes, or cancellations due to events beyond our reasonable control — including but not limited to bushfires, floods, road closures, pandemics, industrial disputes, or government orders. In such cases, we will make reasonable efforts to offer alternative arrangements but cannot guarantee availability.

4. Behaviour & Substance Policy

You must follow all safety instructions given by our staff and act with courtesy toward other passengers, staff, and the public. We have a zero tolerance policy for unsafe behaviour, harassment, or excessive use of alcohol or drugs during our services. We may refuse service or remove you from a tour/vehicle without refund if you breach this policy.

5. Photographic & Media Release

From time to time, we may take photos or videos for marketing, safety, or record keeping purposes. By participating, you consent to us using your likeness for these purposes unless you notify us in writing before your booking date. We respect your right to opt out.

6. Compliance with Land Access & Permit Laws

Certain activities, routes, or locations may require government permits or permissions (including national parks, Aboriginal land, or heritage sites).
We will only operate in compliance with relevant laws and regulations. If permits cannot be obtained, we may adjust the itinerary without liability.

7. Equipment & Gear Responsibility

You are responsible for the safety and care of any personal or hired equipment you bring — such as bikes, surfboards, cameras, or motorsport gear. We are not liable for loss, theft, or damage to such equipment unless caused by our proven negligence.

8. Damage to Property or Vehicles

You may be charged for any damage you cause to our vehicles, equipment, or other property, beyond normal wear and tear.

9. Medical Conditions & Disclosure

For safety reasons, you must disclose any medical conditions, allergies, or medications that could impact your participation in our services. This information will be kept confidential in accordance with Australian privacy laws.

10. No Warranty / Activity Outcomes

While we take all reasonable care in planning, we cannot guarantee weather conditions, wildlife sightings, or specific outcomes of adventure or motorsport activities.

11. Third Party Services Disclaimer

We may use accommodation, dining, or activity providers operated by third parties. We are not responsible for their performance, safety, or service quality.

12. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the value of the service purchased. Nothing in these Terms limits your rights under the Australian Consumer Law.

13. Dispute Resolution

Before taking legal action, both parties agree to first attempt to resolve disputes through goodfaith negotiation. If unresolved, the matter will proceed to mediation in South Australia, unless both parties agree otherwise.
